These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Temple Seven Press, Inc., a corporation organized under the laws of the State of Wyoming, United States, doing business under the imprint and storefront name "Temple Seven" (together with its affiliates, "Temple Seven," "Company," "we," "us," or "our"), governing your access to and use of the website located at www.templeseven.com, together with all related applications, subdomains, digital storefronts, subscription services, and content offered by the Company (collectively, the "Services").

BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, PURCHASING A PRODUCT, SUBSCRIBING TO A PAID TIER, OR OTHERWISE INDICATING ASSENT (INCLUDING BY CLICKING "I AGREE" OR A SIMILAR MECHANISM), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, COOKIE POLICY, AND REFUND POLICY, EACH OF WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICES.

1. Acceptance of Terms; Eligibility to Contract

These Terms apply to every visitor, registered user, subscriber, purchaser, and affiliate who accesses or uses the Services, regardless of the device or location from which access occurs. The Services are offered globally, and by using them you agree that these Terms govern your relationship with the Company irrespective of your country of residence, subject to the jurisdiction-specific protections described in Section 24.

You represent that you are at least thirteen (13) years old, or sixteen (16) years old if you reside in a jurisdiction of the European Economic Area that sets a higher age of consent for information-society services, and that if you are a minor under the age of legal majority in your jurisdiction, you have your parent's or legal guardian's permission to use the Services and to make any purchase, and that they have read and agree to these Terms on your behalf where required. Any purchase, Subscription, or other transaction requiring a payment method must be made by, or with the express permission and involvement of, an adult with legal capacity to contract and a valid payment method. If you are accessing the Services on behalf of an entity, you represent that you have authority to bind that entity to these Terms, and "you" thereafter refers to that entity. The Services are not directed at children under thirteen (13), and the Company does not knowingly collect personal information from children under that age; see our Privacy Policy for further detail.

2. Definitions

  • "Digital Product" means any e-book, PDF, EPUB, audio file, or other downloadable or streamable file made available for purchase or free access through the Services.
  • "Print Product" means any physical, print-on-demand paperback book fulfilled through our third-party print partner.
  • "Edition" means a cleaned, revived, transcribed, corrected, formatted, annotated, illustrated, or otherwise enhanced version of a work in the public domain, prepared by or for Temple Seven.
  • "Source Work" means the underlying historical text, in the public domain in the relevant jurisdiction, from which an Edition is derived.
  • "Subscription" means a recurring, paid access plan described in Section 5.
  • "Account" means the registered user profile through which you access paid content, manage Subscriptions, and view order history.
  • "Fulfillment Partner" means Lulu Press, Inc., or any successor or additional print-on-demand or distribution vendor engaged by the Company from time to time.
  • "Payment Processor" means Stripe, Inc. and its affiliates, or any successor payment processor engaged by the Company.

3. Accounts

Certain features, including purchase history, Subscriptions, digital library access, and gift card balances, require an Account. You agree to provide accurate, current, and complete information during registration and to promptly update such information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account, whether or not authorized by you. You must notify us promptly at the contact address in Section 25 upon learning of any unauthorized use of your Account. We are not liable for any loss arising from your failure to safeguard your credentials, though we will not unreasonably withhold assistance in securing a compromised Account.

We reserve the right to suspend or terminate an Account, with or without notice, if we reasonably believe the Account has been used in violation of these Terms, applicable law, or in a manner that creates risk or legal exposure for the Company, its Fulfillment Partner, or its Payment Processor.

4. Description of the Services

Temple Seven publishes cleaned, revived, and enhanced Editions of public-domain books. Through the Services, you may: (a) read most of the catalog free of charge directly on the website; (b) purchase Digital Products for download; (c) purchase Print Products fulfilled on a made-to-order, print-on-demand basis; (d) subscribe to a paid tier for expanded reading access and store discounts as described in Section 5; (e) purchase and redeem gift cards; and (f) make voluntary donations that help offset the cost of the AI-assisted and human editorial processing used to prepare our Editions. The composition of the free catalog, the pricing of paid offerings, and the features attached to any Subscription tier may change from time to time in our discretion, as described in Section 25.

5. Free Access, Subscriptions, and Store Discounts

Most of the Temple Seven catalog is available to read on-site free of charge, without the need for a paid Subscription. A Subscription is optional and unlocks expanded reading access (which may include early access, ad-free reading, offline reading, or additional titles, as described on the pricing page current at the time of your purchase) and discounts on Digital Product and Print Product purchases in the store. Subscription tiers, their features, and their prices are as displayed on the Services at the time of signup and are subject to change on a prospective basis in accordance with Section 9.

Access granted under a Subscription is personal to your Account and is licensed, not sold, to you for so long as your Subscription remains active, subject to Section 6.

6. License to Digital Products; No Transfer of Copyright

When you purchase or otherwise lawfully obtain a Digital Product (including through free access or a Subscription), the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, store, and use one copy of the Digital Product for your personal, non-commercial use on devices you own or control. This license does not include, and you agree not to undertake, any of the following without our prior written consent: (a) reproduction or redistribution of the Edition file, in whole or in part, to any third party or public platform; (b) resale, rental, lending, or sublicensing of the Edition file; (c) removal of any Temple Seven branding, front matter, colophon, or copyright/edition notice; or (d) use of the Edition file, or any output derived from it, to train, fine-tune, or evaluate a machine-learning or artificial-intelligence model.

Nothing in this Section restricts your use of the underlying Source Work itself to the extent it is genuinely in the public domain in your jurisdiction; the license restrictions in this Section 6 attach only to the specific Edition file we deliver to you — that is, to our cleaned text, formatting, layout, cover art, introductions, annotations, illustrations, and other original contributions described in Section 16 — and not to the public-domain content those contributions embody. All Digital Product sales, once delivered, are final except as expressly set out in Section 14.

7. Print Products; Order and Fulfillment

Print Products are made to order and fulfilled through our Fulfillment Partner. Print Products are currently shipped only to addresses in the United States, Canada, the United Kingdom, Ireland, Australia, and New Zealand. We do not currently offer print shipping to other countries; digital purchases and free reading access remain available worldwide regardless of shipping eligibility.

Because Print Products are manufactured specifically for your order upon purchase, production begins promptly after payment is confirmed. Order details (including recipient name, shipping address, and edition selected) are your responsibility to verify before completing checkout, as further described in Section 9.

8. Pricing, Payment, and Taxes

All prices are displayed in the currency shown at checkout and are payable in full at the time of purchase for one-time purchases, or on the recurring schedule described in Section 9 for Subscriptions. Payments are processed exclusively by our Payment Processor, Stripe, which supports major credit and debit cards, Apple Pay, Google Pay, and Link. The Company does not receive, process, or store your full card number, CVV, or other sensitive payment card data; that information is handled directly by Stripe in accordance with its own terms and applicable payment card industry standards.

Sales tax, value-added tax ("VAT"), goods and services tax, and other applicable transaction taxes are calculated and collected at checkout using Stripe Tax based on your billing location and the tax treatment applicable to the product purchased, where the Company has a legal obligation to collect such tax. You are responsible for any taxes not collected by us that may be owed in your jurisdiction, including import duties or customs charges that may apply to Print Products shipped internationally.

9. Subscription Billing, Renewal, and Cancellation

Before you complete a Subscription purchase, we will clearly and conspicuously disclose, at or immediately before the point of payment: (a) the Subscription tier and its price; (b) that the Subscription will automatically renew and bill on a recurring monthly basis unless cancelled; (c) the amount and frequency of recurring charges; and (d) how to cancel. By completing the purchase, you provide affirmative consent to these recurring, automatic renewal charges to your payment method on file, and this consent is collected at the time of signup as a condition of activating the Subscription, consistent with applicable automatic-renewal laws (including California's Automatic Renewal Law and comparable state statutes).

You may cancel your Subscription at any time from your Account page. Cancellation stops future recurring charges but does not terminate your access immediately: you will retain full access to the Subscription's benefits through the end of the billing period you have already paid for. No pro-rated refunds are issued for the unused portion of a billing period upon cancellation, whether the cancellation is initiated by you or results from a change in the Subscription's features. If a renewal payment fails, we may suspend Subscription benefits until payment is successfully processed or the Subscription is cancelled. We will send you lifecycle emails confirming Subscription start, renewal, payment failure, and cancellation.

10. Gift Cards and Promotional Codes

Temple Seven gift cards may be purchased for use toward Digital Products, Print Products, and Subscriptions on the Services. Gift card funds do not expire and are not subject to dormancy, inactivity, or maintenance fees of any kind. There is no fee charged to purchase a gift card. Gift cards are non-refundable and non-redeemable for cash, except where required by applicable law. Gift cards are not reloadable payment cards, are not issued by a bank, and carry no interest. Lost or stolen gift card codes may be deactivated at our discretion upon satisfactory proof of original purchase, but the Company cannot guarantee recovery of unused balances on codes that have already been redeemed by a third party. To the extent required by applicable unclaimed-property or escheatment law, we may be required to report and, where mandated, remit balances on inactive gift cards to the appropriate state or territorial authority; this does not affect your ability to redeem a gift card that has not expired.

We may from time to time offer promotional or discount codes, referral rewards, or similar incentives ("Promo Codes"). Promo Codes are subject to any eligibility criteria, expiration dates, usage limits, and product exclusions stated at the time they are offered, are not combinable with other Promo Codes or offers unless expressly stated, have no cash value, and may not be sold, transferred, or auctioned. We reserve the right to modify, suspend, or terminate any Promo Code or promotional program at any time, and to void transactions or reclaim credits obtained through fraud, abuse, or violation of these Terms.

11. Donations

The Services allow you to make a voluntary donation to help offset the computing, editorial, and processing costs associated with producing our Editions. Temple Seven Press, Inc. is a for-profit corporation and is not a registered charity, non-profit organization, or tax-exempt entity in any jurisdiction. Donations made through the Services are not charitable contributions, are not tax-deductible, and do not entitle the donor to any goods, services, equity, or other consideration beyond our thanks. Donations are non-refundable except where required by applicable law or at our sole discretion.

12. Editorial Process; Source Material Disclaimer

Our Editions are produced by cleaning, digitizing, transcribing, correcting, and reformatting historical Source Works using a combination of optical character recognition, artificial-intelligence-assisted processing, and human editorial review. Because Source Works are frequently drawn from scans of aged, damaged, or inconsistently printed originals, an Edition may contain minor imperfections inherent to that process — including, without limitation, occasional OCR misreadings, spacing or formatting irregularities, or inconsistencies carried over from the original historical printing. Such minor imperfections are an inherent characteristic of public-domain historical republishing and do not, by themselves, constitute a defect, error, or basis for a refund or replacement under Section 14. Material production errors — such as a corrupted digital file, a misprinted or damaged physical copy, delivery of the wrong title or edition, or non-delivery — are addressed under Section 14.

13. Affiliate Program

We may offer an affiliate/creator program under which approved participants ("Affiliates") earn commissions, calculated on a profit basis as defined in the separate affiliate agreement, for referring purchasers to the Services. Affiliates are independent contractors and are not employees, partners, joint venturers, or agents of the Company, and have no authority to bind the Company or make representations on its behalf. Commission rates, tier thresholds, referral/attribution windows, discount levels, payout minimums, and other program terms are set out in a separate affiliate agreement made available to enrolled Affiliates and are subject to change by the Company at any time, in its discretion, on a prospective basis only: a change to program terms applies to commissions earned on referrals occurring after the effective date of the change and does not retroactively reduce or claw back commissions already earned on completed, qualifying transactions prior to that date, except in cases of fraud, abuse, or a chargeback or refund of the underlying transaction. Participation in the affiliate program is itself subject to these Terms and to the Company's approval and ongoing eligibility criteria, and may be suspended or terminated for suspected fraud, self-referral, spam, or violation of applicable advertising or disclosure laws, including applicable FTC endorsement guidance in the United States and equivalent rules elsewhere; Affiliates are responsible for making all disclosures required by such laws in their own promotional activity.

14. Cancellations, Returns, Refunds, and Replacements

All sales are final, except as expressly provided in this Section. Because Digital Products are delivered instantly and Print Products are manufactured to order specifically for you, we do not offer refunds or exchanges for buyer's remorse, mistaken purchase, or change of mind.

We will replace or refund, at our discretion, in the following circumstances:

  • Print Products that arrive damaged, defectively bound or printed, or misprinted.
  • Print Products that are the wrong title, wrong edition, or otherwise materially different from what you ordered.
  • Print Products that are never delivered, where tracking confirms non-delivery and the shipping address you provided was correct.
  • Digital Product files that are corrupted or fail to open or render using standard, current software for the file format purchased.
  • Any order where our Fulfillment Partner fails to complete print production of a Print Product; in that circumstance you will automatically receive a full refund for that order without needing to make a request.

To request a replacement or refund under this Section, contact us using the details in Section 25 within a reasonable time after discovering the issue, and, for physical defects, provide photographic evidence where requested. Print orders cannot be cancelled once they have been submitted to the Fulfillment Partner for production, because production begins immediately upon order confirmation; cancellation requests received before production has begun will be honored where our systems and those of our Fulfillment Partner permit it. Nothing in this Section limits any non-waivable statutory right you may have as a consumer, including the statutory rights of United Kingdom and Irish consumers described in Section 24. For full detail, see our separate Refund Policy, which is incorporated into these Terms by reference.

15. Shipping and Risk of Loss

Digital delivery is free and instantaneous upon successful payment. Shipping for Print Products is a paid service, calculated at checkout based on destination, weight, and service level offered by our Fulfillment Partner. Estimated delivery windows shown at checkout are provided by the Fulfillment Partner and are not guaranteed delivery dates. Risk of loss and title for Print Products passes to you upon delivery to the carrier, except that, as between you and the Company, we remain responsible for resolving delivery failures, damage, and misprints as described in Section 14.

16. Intellectual Property

The Source Works underlying our Editions are, to the best of our knowledge and belief, in the public domain in the United States and in the jurisdictions in which we make them available; the Company makes no claim of copyright in a Source Work itself. Source Works are drawn from established public-domain repositories such as the Internet Archive, Project Gutenberg, and the Library of Congress, and each title's public-domain status is checked using an AI-assisted verification process together with human editorial review before publication, with verification records retained per title. However, Temple Seven Press, Inc. and its licensors own all right, title, and interest — including copyright — in and to the original, copyrightable contributions embodied in each Edition, including our transcription and correction work product, typesetting and interior layout, cover art and design, introductions, footnotes, annotations, glossaries, illustrations added by us, curated compilations, and the Temple Seven name, marks, logos, and "Antiquarian Reprint Collection" imprint line, and colophon (collectively, "Company IP"). Company IP is protected by United States and international copyright, trademark, and other intellectual property laws. Digital Product files may include a traceable watermark or similar identifier tied to your purchase.

Except for the limited license expressly granted in Section 6, no right, title, or interest in any Company IP is transferred to you, and all rights not expressly granted are reserved. You may not use the Temple Seven name or marks in connection with any product or service without our prior written consent, except for accurate, non-misleading attribution (for example, citing an Edition you have purchased). If you believe your copyright has been infringed by content on the Services, see our Copyright Notice for our takedown procedure.

17. User Conduct and Acceptable Use

You agree not to, and not to attempt to: (a) circumvent, disable, or otherwise interfere with security-related or access-control features of the Services, including measures that prevent bulk downloading or scraping of our catalog; (b) use any automated means (bots, scrapers, crawlers) to access the Services for a purpose other than standard search-engine indexing without our prior written consent; (c) resell, redistribute, or publicly mirror our Editions or substantial portions of the Services; (d) reverse engineer, decompile, or extract the underlying source files of our Digital Products beyond what is inherent in ordinary reading use; (e) use the Services to upload or transmit malicious code; (f) impersonate any person or entity or misrepresent your affiliation; (g) use the Services in a manner that violates any applicable law, including export control, sanctions, consumer protection, or intellectual property law; or (h) abuse the gift card, donation, Subscription, or affiliate systems, including through fraudulent chargebacks, self-referral abuse, or promotional-code abuse.

We reserve the right to investigate suspected violations of this Section and to suspend or terminate access, withhold affiliate commissions reasonably believed to result from fraud, and pursue any other remedy available at law or in equity.

18. Reviews and User Submissions

Certain features that would allow you to submit reviews, ratings, comments, essays, or other content ("User Submissions") are not currently enabled on the Services; as of the effective date of these Terms, the Company is the sole publisher of content on the Services and no third party may post text, images, or other content. This Section will govern User Submissions if and when such features are enabled. Where enabled, you will represent that you own or have the necessary rights to the User Submission and that it does not infringe any third party's rights or violate any law. By submitting a User Submission, you will grant the Company a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, publish, translate, and display the User Submission in connection with the Services and our marketing of the Services. We reserve the right to remove or decline to publish any User Submission at our discretion, including for content that is defamatory, obscene, harassing, or otherwise objectionable, and to provide a mechanism for reporting or flagging User Submissions before any such feature is made publicly available.

19. Third-Party Services

The Services rely on and integrate with third-party providers, including Stripe (payment processing) and Lulu Press, Inc. (print-on-demand manufacturing and shipping), and may link to or embed content from other third parties (collectively, "Third-Party Services"). Your use of Third-Party Services is subject to their own terms and privacy policies, which we encourage you to review. The Company does not control and is not responsible for the acts, omissions, availability, or content of Third-Party Services, though we will use commercially reasonable efforts to assist in resolving issues that affect your order, as described in Section 14.

20. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, THE SOURCE WORKS, AND ALL EDITIONS, DIGITAL PRODUCTS, AND PRINT PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE HISTORICAL, FACTUAL, OR TRANSLATIONAL ACCURACY OF ANY SOURCE WORK, WHICH REFLECTS THE VIEWS, LANGUAGE, AND SCHOLARSHIP OF ITS ORIGINAL TIME OF PUBLICATION.

Nothing in this Section is intended to exclude or limit any warranty, guarantee, or right that cannot lawfully be excluded or limited under the law of your jurisdiction, including statutory consumer guarantees available to United Kingdom, Irish, Australian, New Zealand, and Canadian consumers.

21. Limitation of Liability; Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TEMPLE SEVEN PRESS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

These limitations do not apply to liability that cannot be limited or excluded under applicable law (including, in some jurisdictions, liability for death, personal injury, or fraud), and do not affect any non-waivable statutory rights of consumers described in Section 24.

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms, your User Submissions, or your misuse of the Services, except to the extent such claims arise from the Company's own breach of these Terms or violation of applicable law.

22. Export Control, Sanctions, and Legal Compliance

The Services and Digital Products may be subject to United States export control and economic sanctions laws. You represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive U.S. trade embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable import and export laws in connection with your use of the Services.

23. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles, except to the extent a mandatory consumer-protection law of your country of residence requires the application of local law, in which case that mandatory law will apply solely to the extent required.

Before initiating a formal proceeding, you agree to first contact us at the address in Section 25 so that we can attempt to resolve the dispute informally. If a dispute is not resolved informally within sixty (60) days, either party may pursue the dispute in the state or federal courts located in the United States, and you and the Company each consent to the personal jurisdiction of such courts and waive any objection to venue, except where applicable consumer-protection law grants you the right to bring or defend proceedings in the courts of your own country of residence, which right is preserved. To the extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

24. International Users and Jurisdiction-Specific Terms

The Services are made available to a global audience, and digital purchases and free reading access are not geographically restricted. Print Products currently ship only to the United States, Canada, the United Kingdom, Ireland, Australia, and New Zealand. Because you are contracting with a Wyoming corporation, the general provisions of these Terms (including Section 23) apply to all users; however, the following jurisdiction-specific protections are also expressly preserved and will control over any conflicting provision of these Terms to the extent required by mandatory local law:

  • United Kingdom and Ireland: If you are a consumer resident in the United Kingdom or Ireland, nothing in these Terms affects your statutory rights under the UK Consumer Rights Act 2015 or, as applicable, Irish and EU consumer protection law, including your rights regarding goods that are not of satisfactory quality, not fit for purpose, or not as described, and your rights regarding digital content that is not of satisfactory quality. Where those statutory rights are broader than the contractual remedies described in Section 14, your statutory rights prevail. For Print Products shipped to the United Kingdom or Ireland, you have the right to cancel your order and receive a refund within fourteen (14) days of delivery, in addition to the remedies described in Section 14, unless and to the extent a specific title is genuinely bespoke or personalized to your specification (which our standard catalog titles are not). For Digital Products, because content is delivered immediately upon purchase, we will ask for your explicit acknowledgment and consent at checkout that you wish delivery to begin immediately and that, by doing so, you lose your statutory right to cancel once delivery has begun; absent that acknowledgment, the standard fourteen-day digital withdrawal right applies.
  • European Union: If you are a consumer resident in the EU, you may have withdrawal and conformity rights under EU consumer protection directives as implemented in your member state, to the extent applicable to the digital content and goods described in these Terms. For digital content, we will request your express prior consent and acknowledgment at checkout that performance will begin immediately and that you will thereby lose your statutory right of withdrawal once delivery has begun, consistent with Article 16(m) of the EU Consumer Rights Directive as implemented in your member state; absent that acknowledgment, the standard withdrawal period applies. For Print Products, the same regional return treatment described for the United Kingdom and Ireland above applies to the extent required by your member state's implementation of EU consumer protection law.
  • Canada: If you are a consumer resident in Canada, nothing in these Terms limits any non-waivable right or remedy available to you under applicable federal or provincial consumer protection legislation.
  • Australia: If you are a consumer resident in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law that cannot lawfully be excluded.
  • New Zealand: If you are a consumer resident in New Zealand, nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 to the extent those Acts apply and cannot lawfully be excluded.

If any provision of Section 23 or elsewhere in these Terms is found unenforceable against a consumer in a particular jurisdiction because it conflicts with a mandatory local consumer-protection rule, that provision will be enforced to the maximum extent permitted in that jurisdiction, and the remainder of these Terms will remain in full force under Section 25.

25. General Provisions

Changes to These Terms. We may revise these Terms from time to time to reflect changes in our Services, legal or regulatory requirements, or business practices. If we make material changes, we will post the updated Terms on this page with a new "Last Updated" date and, where required by law, provide additional notice. Your continued use of the Services after the effective date of any revision constitutes acceptance of the revised Terms.

Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, Copyright Notice, and any order-specific terms presented at checkout, constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings on that subject.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.

Force Majeure. We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, labor disputes, internet or utility failures, or acts of our Fulfillment Partner or Payment Processor beyond our reasonable control.

Relationship of the Parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and the Company, except as expressly stated with respect to Affiliates in Section 13.
